The court will probably say it's theft, but here's what I see: People come to Bitcoin because they wanted a system with no authority and rules enforced by math. There is no concept of theft in the code. There's is only valid cryptographic signatures. When the rules allow a valid transaction to occur that people think it's theft, they start appealing to an external authority to force the return of the funds. If an external authority can dictate that certain valid transactions are actually invalid, and force another transaction to reverse the move, then Bitcoin becomes less sovereign.
