If I have to get my transaction mined an obscure pool somewhere and it takes hours or days, And maybe I have to do some out of band payment It's hard to not see that as "effectively stopped. "

Monero certainly needs more pools, but the ones we have are not regulated. Since mining is not kyced or regulated, it doesn't have the same class of problems.
